Sexual orientation: Discrimination against homosexuals not covered by SDA

The Sex Discrimination Act 1975 does not protect homosexuals from discrimination on grounds of their sexual preference, holds the EAT in Smith v Gardner Merchant Ltd 13.2.96 EAT 831/95. Discrimination on grounds of homosexuality in either sex is discrimination on grounds of sexual orientation, of which there is no mention in either the Act or the EC Equal Treatment Directive.
