In South Tyneside Metropolitan Borough Council v Anderson and others [2007] IRLR 715 CA, the Court of Appeal has held that school support staff employed on the recommendation of the governing body of a community school could succeed in their equal pay claims.

A group of female school support staff brought a claim for equal pay and sought to compare themselves with better-paid male workers who were employed under the same White Book grade, but did not work in schools.
