In R v Secretary of State for Social Services ex parte Clarke (29.10.87) EOR17C, the Divisional Court quashes an industrial tribunal decision which held that the employing health authorities had a material factor defence to any pay inequalities because they were bound to comply with the pay scales laid down by the Secretary of State under Regulations. The equal value complaints are remitted to the tribunal to be determined on their merits.
