Statutory dismissal procedure: Solicitor's letter before action did not raise appeal

In Pisciteli v Zilli Fish Ltd 21.12.05 UKEAT/0638/05/DZM, the EAT holds that, on the facts of the case, a solicitor's letter did not raise an appeal against the employee's dismissal. It simply sought a cash settlement in respect of his potential tribunal claims. As a result, the employee could not rely on a reasonable belief that a dismissal or disciplinary procedure was ongoing in order to extend the time limit for submitting his unfair dismissal claim.
