Statutory grievance procedure: Equal pay questionnaire not 'statement of grievance'

In Holc-Gale v Makers UK Ltd 21.12.05 UKEAT/0625/05/SM, the EAT holds that the employment tribunal was correct to find that it did not have jurisdiction to deal with an equal pay claim where the claimant had not complied with the statutory grievance procedure by setting out her grievance in writing and sending it to the employer. While the claimant had sent an equal pay questionnaire to her employer in connection with her claim, reg. 14 of the Employment Act 2002 (Dispute Resolution) Regulations 2004 specifically excludes discrimination questionnaires from being a grievance for these purposes.
