In Plant Construction plc v Clive Adams Associates and JMH Construction Services Ltd, the Court of Appeal considered a subcontractor's duty to warn of dangerously defective works. While sending the case back to the trial judge to reconsider causation, the Court of Appeal held that the subcontractor had a duty to guard against the risk of personal injury as part of its implied contractual duty of care.
