Four employees of a company that supplied catering personnel to work on board a ship were members of the ship's crew and so excluded from the protection of the Transfer of Undertakings Regulations, holds the EAT in Castle View Services Ltd (formerly CCG Services Ltd) v Howes and others 12.4.99 (S)EAT 29/99. For these purposes, the crew constitutes those navigating the vessel, those essentially engaged in that navigation, such as engineers, and those providing essential services to them, including the provision of food.
