In Michael Peters Ltd v Farnfield and another, the EAT holds that the chief executive of a holding company, whose role took in all of the companies in the group, was not employed by any of the four subsidiaries which were transferred. He was not assigned to the part of the undertaking transferred and did not, therefore, fall within the protection of the Transfer of Undertakings Regulations.
