There was no relevant transfer of an undertaking where the contractor taking over a contract for the provision of refuse collection services took on only a minority of the previous contractor's workforce, holds the EAT in North East Lincolnshire Council v Beck and others 21.1.99 EAT 1362/97. Further, the new contractor took on neither its predecessor's premises or administrative staff, nor a significant part of the relevant assets of the undertaking, that is, the refuse collection vehicles. Looking at the matter as a whole, the new contractor took over the activity formerly carried on by its predecessor and no more.
