A transfer of the functions of residential social workers from a local authority abolished as a result of local government reorganisation to a newly created local authority was a relevant transfer for the purposes of the Transfer of Undertakings Regulations, holds the EAT in Dundee City Council v Arshad 19.1.99 (S)EAT 1204/98. Although the reorganisation of public administration or the transfer of administrative functions between public administrative authorities does not constitute a transfer of an undertaking, transfers of identifiable economic entities within local government organisation are not excluded from the scope of the Regulations.
