In LMC Drains Ltd and Metro-Rod Services Ltd v Waugh the EAT holds that the grant or assignment of a franchise agreement to carry on a drain cleaning business constituted a "relevant transfer" for the purposes of the Transfer of Undertakings Regulations 1981. However such a transfer is effected, the EAT confirms, it will be covered by the Regulations as long as the business remains an identifiable economic unit.
