In Puglia v C James & Sons  IRLR 70, the EAT holds that, in calculating the compensatory award of an unfairly dismissed employee, an industrial tribunal was right to deduct from his estimated loss of earnings the invalidity benefit which he received after his dismissal. The EAT declines to follow its recent decision to the contrary in Hilton International Hotels (UK) Ltd v Faraji  IRLR 267, because that was reached without its attention having been drawn to all the relevant authorities.
