Until the Court of Appeal determines the issue, industrial tribunals should follow the most recent EAT decision on the question of reducing the compensation of employees unfairly dismissed while taking part in industrial action, holds the EAT in Crosville Wales Ltd v Tracey and others. A reduction may therefore be made on the grounds of an employee's conduct in participating in the action, but tribunals should not go so far as to conduct a broad "inquest" into the dispute.
