Data Protection (Monetary Penalties) (Maximum Penalty and Notices) Regulations 2010 come into force

Implementation date: 6 April 2010

The Regulations provide that the maximum monetary penalty that the Information Commissioner may impose on a data controller under s.55A of the Data Protection Act 1998 is £500,000. The Regulations also set out the information that the Information Commissioner must include when serving a notice of intent to impose a monetary penalty and that must be set out in a monetary penalty notice.
