Employment Act 2002 (Commencement No 8) Order 2004 comes into force

Where an employee is regarded as automatically unfairly dismissed because one of the statutory dismissal and disciplinary procedures applied in relation to the dismissal, but the procedure was not complied with due to a failure on the part of the employer, the tribunal will make an award of four week's pay (unless it would result in an injustice to the employer). The Order provides that the maximum amount of a week's pay for the purposes of calculating this award is £270. The Order also brings into force the repeals of: the Employment Rights Act 1996, sections 3(3) and (4), 118(4) and 127A; Employment Rights (Dispute Resolution) Act 1998, section 13 and paragraphs 19 to 21, 23 and 26 of schedule 1; and the Employment Relations Act 1999, section 11(6).
