Information and Consultation of Employees (Amendment) Regulations 2006 come into force
Implementation date: 6 April 2006
The Regulations provide that employers making certain
changes to occupational and personal pension schemes are not required to consult
employees or their representatives under the Information and Consultation of
Employees Regulations 2004, as long as they are consulting about them under the
Occupational and Personal Pension Schemes (Consultation by Employers and
Miscellaneous Amendment) Regulations 2006. If the standard information and
consultation provisions apply, an employer can give written notice to employee
representatives that it will be consulting under the 2006 Regulations. If a
negotiated agreement exists which contains requirements to consult on listed
pension changes, an employer can give written notice to employee representatives
or individuals that it will be consulting under the 2006 Regulations (provided
that the agreement was made before 6 April 2006). The Regulations can be viewed on the OPSI
