Rehabilitation of Offenders Act 1974 (Exclusions and Exceptions) (Scotland) Order 2013 comes into force

The order revokes and replaces the Rehabilitation of Offenders Act 1974 (Exclusions and Exceptions) (Scotland) Order 2003 (SI 2003/231). It excludes s.4(2)(a) and (b) of the Rehabilitation of Offenders Act 1974, which relates to questions asked about criminal convictions (otherwise than in the course of judicial proceedings), in relation to questions to assess a person's suitability for certain professions, offices, employments and occupations. The professions, offices, employments and occupations are also excepted from s.4(3)(b) of the Act, which relates to the effect of a spent conviction on grounds for dismissal and exclusion of persons from certain types of work.
