Requirement for employers to report annually on whistleblowing claims introduced

Implementation date: To be confirmed

Section 148 of the Small Business, Enterprise and Employment Act 2015 provides for regulations to be made that will require employers that are "prescribed persons", that is included in the Public Interest Disclosure (Prescribed Persons) Order 1999 (SI 2014/2418), to report annually on whistleblowing claims that they receive. This will include information on the number of disclosures made and the number of disclosures where the employer decided not to take any further action. Employers will be required to publish the report annually. The Government consulted on its proposals and published draft Regulations that set out the specific details of the requirement, as part of its response to the consultation.
