Sunday working: Deal with a shop or betting worker's notice to opt out of Sunday working

When to use this workflow

Use this workflow when you receive notice from a "non-protected" shop or betting worker that he or she wishes to opt out of Sunday working.

Shop or betting workers who, under their employment contract, are, or may be, required to work on Sundays have the right to opt out of Sunday working by giving notice that they object to it (so long as they are not employed to work on Sundays only).

The workflow should not be used for "protected" workers, who do not need to opt out of Sunday working by giving notice as they cannot be required to work on Sundays.

This workflow is an example of a legally compliant process. Where your organisation's own procedures go beyond the procedure set out in this workflow, you should follow these.

Key Steps

  • Check that the notice of objection is in the required format
  • Check whether or not you provided a statement setting out the employee's right to opt out of Sunday working
