XpertHR WeeklyOn this week's XpertHR Weekly, we discuss the employment tribunal decision in Mba v The Mayor and Burgesses of the London Borough of Merton ET/2350743/10, in which the tribunal held that the employer's business requirements outweighed the Christian claimant's desire not to work on Sundays because it is a day of worship and rest. We also discuss the European Court of Justice decision in Meister v Speech Design Carrier Systems GmbH Case C-415/10 ECJ, in which the European Court held that an employer is not obliged to provide an unsuccessful job applicant with information on the successful candidate, although a failure to do so could lead to an inference of discrimination in a subsequent tribunal claim.
