Advise an employee on the qualifying criteria for the right to request flexible working

Key points

  • Where an employee expresses an interest in changing his or her hours and/or place of work, it is good practice for the employer to advise him or her on the qualifying criteria for the statutory right to request flexible working.
  • To be eligible, the employee must meet the requirement in relation to continuous service with the employer, and must not have submitted a statutory request in the preceding 12 months.
  • There is no longer a requirement that the purpose of the employee's request is to provide care.
