Manage an employee who wants to return to work early from adoption leave

  • If an employee wishes to return to work earlier than the date on which he or she is otherwise due to return from adoption leave, there is a minimum period of notice, set out in the relevant legislation, that the employee must give of the revised date of return.
  • The employer can prevent the employee from returning early (or send him or her home) if the employee has not given the required notice, but only if the employer has complied with certain notice requirements itself.
