Respond to a data subject access request, providing the required information

Key points

  • Under the Data Protection Act 1998, on payment of a fee (which must not exceed the amount set out in the legislation), employees are entitled to write to their employer asking for details of any personal data held on them and why it is being held. They also have the right to be provided with a hard copy of the relevant data.
  • Where the employer receives such a request, it must provide the required information within the prescribed time limit.
