Respond to an employee's paternity leave/pay notice in relation to an adopted child
- To exercise his or her right to paternity leave in an adoption situation, an employee is required to give the employer notice providing specified information no more than seven days after the date on which the adopter is notified that he or she has been matched with a child for adoption.
- Where the employee wishes to exercise his or her right to statutory paternity pay, the employee must provide additional specified information.
- Different timescales apply where the child is being adopted from overseas.
- The employer should respond to the employee's notice confirming the arrangements or stating that the employee does not qualify. If the employee does not qualify for statutory paternity pay, the employer is obliged to respond within a set time frame.
