Take disciplinary action against a local authority head of paid service, monitoring officer or chief finance officer: local authority
- If a local authority employer is considering disciplinary action against the head of paid service, monitoring officer or chief finance officer (the "section 151 officer"), it must comply with certain statutory requirements.
- The relevant procedural requirements were amended in May 2015. Where anything has already been done in relation to an allegation of misconduct before 11 May 2015, the authority must appoint a designated independent person to carry out an investigation into the matter and make a report to the authority.
- Different rules must be implemented after 11 May 2015, providing for the appointment of a panel to advise on the dismissal of a senior officer.
- Local authority employers must understand the role and powers of the panel (or the designated independent person if relevant) and the limits that are placed on the action that an authority can take in these circumstances.
