    In Consistent Group Ltd v Kalwak and others [2008] EWCA Civ 430, the Court of Appeal remitted to a fresh tribunal the issue of whether or not Polish nationals engaged by an agency to work as meat packers for a third party were employees of the agency.

    The Court of Appeal has overturned an Employment Appeal Tribunal (EAT) decision approving a tribunal ruling that an employment agency had entered into contracts of employment with workers.

    In James v London Borough of Greenwich [2008] EWCA Civ 35, the Court of Appeal held that, in the absence of an express contract between an agency worker and the end user, a contract will be implied only where it is necessary to do so to give business reality to the situation.

    In National Grid Electricity Transmission plc v Wood EAT/0432/07, the EAT held that, where an individual was engaged as an agency worker, but in the course of his work entered into direct negotiations with the end user about his terms and conditions on issues relating to pay, notice and holiday, it was necessary to imply a contract of employment between him and the end user to reflect the reality of the relationship.

    In Enfield Technical Services Ltd v Payne; Grace v BF Components Ltd EAT/0644/06, the EAT holds that the contracts of employment were not tainted by illegality because, although the parties had wrongly characterised them as contracts of self-employment, in neither case had the parties misrepresented to the authorities the facts of their relationship.
