    In Parsons v East Surrey Health Authority (25.6.86) EOR10C, the EAT holds that the European Court of Justice's decision in Marshall v Southampton and South-West Area Health Authority that discriminatory retirement ages for men and women are incompatible with the Equal Treatment Directive is declaratory of the existing law.

    In R v Secretary of State for Education, ex parte Schaffter (30.7.86) EOR10D, Mr Justice Schiemann in the Queen's Bench Division rules that the statutory scheme for the provision of education grants which restricts hardship grants for lone parents to parents who have once been married is indirectly discriminatory on grounds of sex and contravenes the EEC Equal Treatment Directive.
