The House of Lords in Vehicle Inspectorate v Nuttall finds that an employer that chooses not to examine its drivers' tachograph records fails to take the steps a reasonable employer would take to prevent it contravening the "drivers' hours" Regulation and, on the face of it, "permits" its employees to contravene the Regulation.
