Editor's message: It is good practice for you to be proactive in planning for adoption leave. This will have several benefits, including ensuring that there is adequate cover for the employee's work while he or she is on leave, and that the employee knows in good time what his or her rights and duties are in respect of the leave.

Eligible employees have the right to take up to 26 weeks' ordinary adoption leave, followed immediately by up to 26 weeks' additional adoption leave (ie a total period of up to 52 weeks' adoption leave).

Adoption leave is available to one member only of a couple where a child is placed with them both for adoption. It is up to the adoptive parents to decide which of them takes the adoption leave. The other member of the couple may be entitled to a period of paternity leave.
