The Order amends a number of statutory instruments pursuant to the provisions in the Pensions Act (Northern Ireland) 2008 that introduce a single contribution condition for entitlement to state pension and amend the
rules for calculating the state second pension.
The Regulations prescribe the limit on the total amount of additional state
pension that a person can receive when he or she is entitled to his or her own additional state pension and an inherited additional state pension following the death of his or her spouse or civil partner.
The Regulations make amendments to various enactments following the equalisation of state pension provision for men and women introduced by the Pensions Act 1995 and reforms to state pensions introduced by the Pensions Act 2007.
The Order sets the low earnings threshold, which is the amount by reference to which the three surplus earnings bands are determined for the purpose of calculating the additional pension (the state second pension) in a state retirement pension.
