These Regulations specify the circumstances in which employers may permit individuals, who are not already engaged in work for the employer which is a controlled activity, to undertake work in England
which is a controlled activity.
The Regulations add regulated and controlled activities to the list of purposes for which an enhanced criminal record certificate may be sought, pursuant to the introduction of the vetting and barring scheme in Northern Ireland provided by the Safeguarding Vulnerable Groups (Northern Ireland) Order 2007.
The Order brings within the definition of regulated activity persons who occupy certain positions where, although they may not always work or have contact with vulnerable groups, they exercise some degree of control or make decisions relating to vulnerable groups under the Safeguarding Vulnerable Groups (Northern Ireland) Order 2007 (SI 2007/1351).
