The employer is a start-up company and has been in existence for nine months. It has a permanent workforce of 56 full-time employees who are contracted to work in excess of 75 hours per month.
On 6 April 2015, the employer received a request to negotiate an information and consultation agreement. Shortly after receiving the request the employer dismissed 15 of its employees due to a downturn in work.
