Call for submissions on the use of non-disclosure agreements (NDAs) in discrimination cases

Close date: 28 November 2018

The Women and Equalities Committee seeks views on the use of non-disclosure agreements (NDAs) in circumstances where harassment or any other form of discrimination is alleged. The Committee's inquiry seeks views on, among other things, whether or not the use of settlement agreements should be banned or restricted in discrimination cases; what safeguards are needed to prevent their misuse; and how easy it is for employees and employers to access legal advice on settlement agreements. The inquiry also explores whether or not some employers repeatedly use NDAs to deal with cases involving a single harasser.
