Consultation on measures to reform non-compete clauses
Close date: 26 February 2021
The Government is seeking views on proposals to restrict the use of non-compete clauses in employment contracts. These clauses aim to curtail the competitive activities of former employees. The Government invites views on:
- a proposal to allow non-compete clauses to remain enforceable, provided that the employer pays compensation to the employee for the duration of the restriction and to introduce additional measures, such as a statutory time limit on the length of these clauses; and
- an alternative proposal to make non-compete clauses in employment contracts unenforceable.
