Duty to notify Secretary of State on collective redundancies

Close date: 9 June 2006

The Government consults on an amendment to the Trade Union and Labour Relations (Consolidation) Act 1992 to take account of the European Court of Justice's decision in Junk v Kühnel [2005] IRLR 310 ECJ, which clarified employers' duties to inform the Secretary of State before undertaking collective redundancies. The amendment will make it clear that these notifications must take place before any notice of redundancy has been issued, rather than before notice of redundancies takes effect.
