Holding an initial settlement discussion with an employee against a background of performance or conduct issues, or prior to a redundancy selection exercise, requires careful handling. It is particularly important to ensure that the conversation, and any subsequent correspondence related to it, proceeds in a way that reduces the risk of the discussion being admissible later in tribunal proceedings.
