Summary

  • A framework for holiday entitlement for staff employed under the terms and conditions of the National Joint Council for Local Government Services is set out in para.7 of part 2 of the Green Book. (See Green Book provisions)
  • The entitlement to four weeks' holiday under the Working Time Directive (2003/88/EC) has direct effect for public workers. This is relevant when considering the issue of sickness absence and holiday. (See Direct effect of the entitlement to four weeks' leave)
  • When "rolling up" holiday pay local authorities are advised to make contractual provision for this and identify a specific sum as being allocated to holiday pay. (See Including holiday pay in wages)
