Are conditional job offers binding?

Employers frequently attach conditions, such as receipt of satisfactory references, to the offer of employment, and an offer is not complete until the conditions are fulfilled. Employers should stipulate a time within which any conditions must be met. If an employer allows an employee to start work without obtaining references, it may not be able to rely on an unsatisfactory reference received at a later date to terminate the contract. There is, in any event, no general legal right to obtain a reference from a previous employer.
