Can a female employee claim equal pay with a man who does a different job where their jobs are rated as equivalent under a job evaluation scheme?

Yes, if a job evaluation scheme commissioned or carried out by the employer has shown that a woman's work and a man's work have been rated as equivalent, the woman will be able to compare themselves to the man for the purposes of the Equality Act 2010. The scheme must be "analytical", with the jobs evaluated in terms of demands under headings such as effort, skill and decision making.

If the jobs would have been rated as equivalent had the evaluation not been made on a sex-specific system (by, for example, giving undue weight to the skills involved in the man's job) the woman will still be able to claim equal pay in reliance on the job evaluation scheme.
