Can an employer deduct overpaid holiday pay from a final salary payment?

Where an employee has taken more than the annual leave to which he or she would otherwise have been entitled to in respect of the period from the beginning of the holiday year to the end of his or her employment, the employer can deduct any excess holiday pay paid only if there is express provision for this within the contract of employment or a relevant agreement. A "relevant agreement" for these purposes is a workforce agreement, any provision of a collective agreement incorporated into the employee's contract, or any other agreement that is legally enforceable as between the employee and employer.
