How much notice is a resigning employee required to give his or her employer?

The statutory minimum notice that a resigning employee is required to give his or her employer is one week where the employee has been employed for at least one month (s.86 of the Employment Rights Act 1996). There is no statutory minimum notice period for employees in their first month of employment.

However, the statutory minimum notice period applies only where there is no contractual provision for the length of notice that the employee is required to give; or where the contractual notice period is less than the statutory minimum. Usually, the notice required from the employee will be the period set out in his or her contract of employment.
