Is the right for shop and betting workers to opt out of Sunday working dependent on a period of continuous employment?

No, there is no requirement for shop and betting workers to have a minimum amount of continuous service before they can opt out of Sunday working. However, they must give their employer at least three months' notice, in writing, of their intention to stop working on Sundays and they must be continuously employed throughout the three-month period.

The Government plans to reduce the notice period for opting out of Sunday working from three months to one month for workers in large shops (ie shops with more than 280m2 of floor space). Provision for this is included in the Enterprise Act 2016, but it is not yet known when this will come into force.
