What happens if the employer refuses to pay a guarantee payment?

An employee can bring an employment tribunal claim concerning an employer's failure to pay a guarantee payment. Such a claim must be presented within three months of the day in question. If the complaint is upheld, the employer will be ordered to pay the employee the amount of the guarantee payment. An employee may not lawfully be dismissed or selected for redundancy for questioning or challenging an employer's refusal or failure to pay a guarantee payment or for bringing proceedings before an employment tribunal.
