What is servitude?

The offence of holding a person in servitude occurs where a worker is required to perform forced or compulsory labour and also to live in another person's property with no possibility of changing his or her condition. The employer must know, or ought to know, that the arrangement is oppressive and not truly voluntary.

There must be elements of coercion and deception on the employer's part towards the worker, for example violence, or threats of violence, to the worker or his or her family, or withholding his or her passport or wages.
