What is the minimum statutory provision for paid holiday?

 

Full-year workers are entitled to a minimum of 5.6 weeks' paid annual holiday (ie 28 days for a worker who works five days a week).

This entitlement is made up of two elements. Regulation 13 of the Working Time Regulations 1998 (SI 1998/1833) provides for four weeks' paid holiday (this implemented EU law requirements) and reg.13A provides for a further period of 1.6 weeks. The minimum 5.6 weeks' paid leave can include any paid time off in respect of bank and public holidays.

The method for calculating the amount to be paid is laid down by statute. An employee who begins employment part way through a leave year is entitled to a proportion of the annual leave equal to the proportion of the leave year that is left to run.

For leave years beginning on or after 1 April 2024, there is a different method for calculating entitlement for irregular hours workers and part-year workers. Paid holiday for these workers will accrue throughout the year, at the rate of 12.07% of hours worked in each pay period, up to a statutory maximum of 28 days per year.
