What rights and benefits must be maintained during a period of ordinary parental leave?
The rights and benefits that must be maintained during a period of ordinary parental leave are set out in reg.17 of the Maternity and Parental Leave Regulations 1999 (SI 1999/3312). The employer must maintain the implied obligation of trust and confidence towards the employee, together with any terms relating to notice of termination of the contract by the employer, compensation in the event of redundancy, and disciplinary and grievance procedures.
The employee is bound by their obligation of good faith towards the employer, and any terms relating to notice of termination of the contract by the employee, disclosure of confidential information, acceptance of gifts or other benefits, and the employee's participation in any other business.
The employer is not under any statutory obligation to pay an employee during a period of ordinary parental leave. That is a matter for contractual agreement. Whether the employee is to retain the benefit of any other terms and conditions of employment during ordinary parental leave will also be a matter for contractual agreement.
