A reference to an employee as "a black sheep" could not be regarded as a reference to colour or ethnic origin, says a Southampton industrial tribunal (Chair: M A Rich) in Clark v B&Q plc.
Alfredo Clark, who is of Portuguese nationality, was employed as a departmental manager in Bognor Regis.
