In Horkulak v Cantor Fitzgerald International the High Court holds that the employer was in repudiatory breach of the implied contractual "trust and confidence" term when its CEO subjected a senior manager to outbursts of foul, abusive and intemperate language and threats of dismissal which undermined his authority and caused him emotional trauma.
