Case
In Howard v (1) Brixington Infants School (2) Devon County Council, the EAT holds that, where the governors of a school with a delegated budget had determined that a teacher employed by a local education authority solely to work at the school should cease to work there, and the teacher had appealed against that determination in time, the governors had to await the practical outcome of that appeal before notifying the local education authority of their determination.
