The Working Time Regulations 1998 permit employers to specify the dates on which workers are to take annual leave, subject to notice requirements that may be varied or excluded by means of a "relevant agreement". In Industrial & Commercial Maintenance Ltd v Briffa EAT/0215/08 & EAT/0216/08, the EAT held that a variation incorporated into the employee's contract of employment amounted to such an agreement.

The Employment Appeal Tribunal has held that a contractual term can override the requirement in the Working Time Regulations 1998 that employers give employees notice of holiday dates that is double the amount of time to be taken.
